This Consumer Health Data Policy provides notice of the practices of Nation Medical Inc., d/b/a TRT Nation, including its subsidiaries and affiliates (together “us,” “our,” or “we”) related to Consumer Health Data as governed by laws in Washington, Connecticut, and Nevada, to the extent that such laws are applicable.

This Consumer Health Data Policy describes certain Consumer Health Data privacy rights. We will not discriminate against you if you exercise your applicable rights as described in this Consumer Health Data Policy. Please note, certain choices may affect our ability to deliver our services to you.

We may change this Consumer Health Data Policy from time to time.  If we make changes, we will notify you by revising the “Last Updated” date at the top of this Consumer Health Data Policy.

Washington My Health My Data Act Consumer Health Data Policy

This Washington Consumer Health Data Policy (“WA CHD Policy”) describes how we Process the Consumer Health Data of Washington residents and individuals whose Consumer Health Data is Collected in Washington (“Washington Consumers”) pursuant to the Washington My Health My Data Act (the “Washington Act”).

In the event of a conflict between any other policy, statement, or notice and this WA CHD Policy, this WA CHD Policy will prevail as to Consumer Health Data Collected under the Washington Act. Capitalized terms that are not otherwise defined in this WA CHD Policy shall be defined as they are in the Washington Act.

Washington Consumer Health Data” means personal information that is linked or reasonably linkable to a Washington Consumer and that identifies the Washington Consumer’s past, present, or future physical or mental health status. Washington Consumer Health Data does not include Publicly Available Information or Deidentified Data.

Nation Medical Inc., d/b/a TRT Nation Collects, and may Share (to a Third Party or Affiliate), the following categories of Washington Consumer Health Data about Washington Consumers:

  • Individual health condition, treatment, disease, or diagnosis information;
  • Social, psychological, behavioural, and medical intervention information;
  • Health-related surgery or procedure information;
  • Use or purchase of prescribed medication information;
  • Bodily function, vital sign, symptoms, or measurement of physical or mental health status information;
  • Diagnosis or diagnostic testing, treatment, or medication information;
  • Gender-Affirming Care Information relating to seeking or obtaining Gender-Affirming Care Services;
  • Reproductive or Sexual Health Information relating to seeking or obtaining Reproductive or Sexual Health Services;
  • Data that identifies a Washington Consumer seeking Health Care Services; and
  • Information Processed to associate or identify a Washington Consumer with the data listed above that is derived or extrapolated from non-health information, such as proxy, derivative, inferred, or emergent data by any means, including algorithms or machine learning.

Nation Medical Inc., d/b/a TRT Nation may obtain the Washington Consumer Health Data described above from the following sources: directly from you; from vendors, business partners, or healthcare or pharmacy providers (such as those that support providing you services you request); from Affiliates; and from Third Parties.

Nation Medical Inc., d/b/a TRT Nation Collects and uses the Washington Consumer Health Data of Washington Consumers described above to the extent necessary to provide a product or service requested by the Washington Consumer or with the Washington Consumer’s Consent, including to:

  • Provide the services requested by Washington Consumers;
  • Monitor visits to our online services and to maintain our online services;
  • Fulfill your order for our services including customer support on your order;
  • Support your use of our services, including recommendations for your use of our products and services
  • Manage and send direct transactional communications;
  • Manage and send direct marketing communications, to develop marketing strategies, to oversee the business development of our products and services and research insights to understand how people use our services;
  • Use for scientific research purposes; and
  • Prevent, detect, protect against, and respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities, or any activity that is illegal under Washington state or federal law; preserve the integrity and security of our systems; and investigate, report, or prosecute those responsible for any illegal action under Washington state or federal law.

Where we require the Washington Consumer’s Consent for Collection for a specified purpose, a description of those purposes is provided to you at the time of Collection.

Under the Washington Act, “Sell” or “Sale” means to exchange Washington Consumer Health Data for money or other valuable consideration. Under the Washington Act, “Share” or “sharing” means to release, disclose, disseminate, divulge, make available, provide access to, license, or otherwise communicate orally, in writing, or by electronic or other means, Washington Consumer Health Data to a Third Party or Affiliate.

Where required by applicable law, we will not Sell Washington Consumer Health Data without first obtaining valid authorization from the applicable Washington Consumer.

Where required by applicable law, we will not Share Washington Consumer Health Data without first obtaining the Washington Consumer’s Consent. Nation Medical Inc., d/b/a TRT Nation Shares the Washington Consumer Health Data of Washington Consumers among our Affiliates to conduct our operations and provide services to Washington Consumers. The categories of Third Parties with which Nation Medical Inc., d/b/a TRT Nation Shares Washington Consumer Health Data are: suppliers of services that support the our services, data storage and e-governance providers, de-identification or aggregation vendors, customer service support providers, compliance support vendors, fraud detection and prevention service providers, payment processors,  e-commerce and financial  operations support vendors, analytics and research providers, technical and interface solution vendors, and cybersecurity service providers.

We also disclose or transfer Washington Consumer Health Data to:

  • Our Processors to provide goods and services in a manner consistent with the purpose for which the Washington Consumer Health Data was Collected and disclosed;
  • Parties with whom the Washington Consumer has a direct relationship for the purpose of providing a product or service requested by the Washington Consumer, in circumstances where we maintain control and ownership of the data and the party only uses the Consumer Health Data at our direction for the purpose for which the Washington Consumer Health Data was Collected or Consented to; or
  • External parties as an asset that is part of a merger, acquisition, bankruptcy, or other transaction in which the party may assume control of all or part of our assets.

Washington Consumers have the right to submit certain requests relating to their Washington Consumer Health Data, as described below. To exercise your privacy rights, please submit a request through our Privacy Request Webform. Any privacy rights request you submit to us is subject to a verification process.

Washington Consumers have the right to:

  • Confirm whether we are Collecting, Selling or Sharing Washington Consumer Health Data concerning the Washington Consumer;
  • Access such Washington Consumer Health Data, including a list of all Third Parties and Affiliates with whom we have Sold or Shared the Washington Consumer Health Data and an active email address or other online mechanism to contact Third Parties;
  • Where Consent is required, withdraw Consent from our Collection and Sharing of Washington Consumer Health Data concerning the Washington Consumer;
  • Request that the Washington Consumer’s Consumer Health Data be deleted; and
  • Appeal any refusal to take action on a request.

 

Other U.S. States Consumer Health Data Policy

This Other U.S. States Consumer Health Data Policy (“General CHD Policy”) describes our practices related to “Consumer Health Data” as defined by U.S. privacy laws, other than the Washington Act (collectively “Consumer Health Data Laws”), including, but not limited to, Nevada’s and Connecticut’s Consumer Health Data Laws, to the extent that such laws are applicable. Capitalized terms that are not otherwise defined in this General CHD Policy shall be defined as they are in applicable law.

Nation Medical Inc., d/b/a TRT Nation Collects, and may Share or disclose (to a Third Party or Affiliate), the following categories of Consumer Health Data about Consumers:

  • Information relating to any health condition or status, disease or diagnosis;
  • Information relating to social, psychological, behavioral or medical interventions;
  • Information relating to surgeries or other health-related procedures;
  • Information relating to the use or acquisition of medication;
  • Information relating to bodily functions, vital signs or symptoms;
  • Information relating to Reproductive or Sexual Health Care;
  • Information relating to Gender-Affirming Care;
  • Information listed above that is derived or extrapolated from information that is not Consumer Health Data, including, without limitation, proxy, derivative, inferred or emergent data derived through an algorithm, machine learning or any other means.

Nation Medical Inc., d/b/a TRT Nation may obtain the Consumer Health Data described above from the following sources: directly from you; from vendors, business partners, or healthcare or pharmacy providers (such as those that support providing you services you request); from Affiliates; and from Third Parties.

Nation Medical Inc., d/b/a TRT Nation Collects, uses, and Shares or discloses the Consumer Health Data of Consumers described above to the extent necessary to provide a product or service requested by the Consumer, with the Consumer’s Consent, or as legally required or permissible, including to:

  • Provide the services requested by Consumers;
  • Monitor visits to our online services and to maintain our online services;
  • Fulfill your order for our services including customer support on your order;
  • Support your use of our services, including recommendations for your use of our products and services;
  • Manage and send direct transactional communications;
  • Manage and send direct marketing communications, to develop marketing strategies, to oversee the business development of our products and services and research insights to understand how people use our services;
  • Use for scientific research purposes; and
  • Prevent, detect, protect against, and respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities, or any activity that is illegal under state or federal law; preserve the integrity and security of our systems; and investigate, report, or prosecute those responsible for any illegal action under state or federal law.

Where we require the Consumer’s Consent for Collection for a specified purpose, a description of those purposes is provided to you at the time of Collection.

As may be required by applicable law, we will not Sell or offer to Sell, or use for targeted advertising Consumer Health Data without first obtaining valid authorization from the applicable Consumer.

Where required by applicable law, we will not Share or disclose Consumer Health Data without first obtaining the Consumer’s Consent. Nation Medical Inc., d/b/a TRT Nation Shares or discloses the Consumer Health Data of Consumers among our Affiliates to the extent necessary to conduct our operations and provide services to Consumers. The categories of Third Parties with which Nation Medical Inc., d/b/a TRT Nation Shares Consumer Health Data are: suppliers of services that support our services, data storage and e-governance providers, de-identification or aggregation vendors, customer service support providers, compliance support vendors, fraud detection and prevention service providers, payment processors,  e-commerce and financial  operations support vendors, analytics and research providers, technical and interface solution vendors, and cybersecurity service providers.

Consumers have the right to submit certain requests relating to your Consumer Health Data as described below. To exercise your privacy rights, please submit a request through our Privacy Request Webform.

Any privacy rights request you submit to us is subject to a verification process. Please follow the instructions we provide you and promptly respond to any follow-up inquires so that we may confirm your identity. If you would like to request us to reexamine requests we were unable to fulfill, you may submit a request via our Privacy Request Webform.

Depending on whether you are a Consumer of an applicable Consumer Health Data Law, you may have the right to:

  • Confirm whether we are Collecting, Selling or Sharing Consumer Health Data concerning the Consumer;
  • Access or review such Consumer Health Data, in a transportable format, including a list of all Third Parties with whom we have Sold or Shared the Consumer Health Data;
  • Make changes to or correct such Consumer Health Data;
  • Where Consent is required, withdraw Consent from, or cease, our Collection, Selling and Sharing (including use for targeted advertising) of Consumer Health Data concerning the Consumer; and
  • Request that the Consumer’s Consumer Health Data be deleted.
